Orders will be accepted strictly on a proforma basis. Any applications for credit will considered only if accompanied by acceptable trade references. If payment is not made by the due date credit terms may be withdrawn. Interest on overdue invoices shall accrue from the date when payment is due until the date of payment at a rate of 2% per month above Barclays Bank's base rate per month from time to time in force and shall accrue after as well as before any judgement.
Inactive customers may be asked to reapply for their trade account. We consider a customer who has not ordered within one year to be inactive.
Orders for non-standard Goods will be accepted only with a minimum of 50% deposit and full payment upon delivery. Any variation in the order agreed between the parties shall entitle MOXON LTD to vary the price to cover the cost of such variation. The contract may in part take the form of Purchase Orders accepted and acknowledged by MOXON LTD and any written agreement entered into with relation to such orders. No works shall commence until such orders have been issued by the Customer and accepted and acknowledged by MOXON LTD. Furthermore no works shall commence until satisfactory payment on account of the contract has been received by MOXON LTD in accordance with our standard terms and with the specific terms of the contract.
Goods supplied or works carried out by MOXON LTD will unless otherwise stated be guaranteed against malfunction or failure as a result of substandard materials, workmanship or design to the extent as this is covered by the contract and for a time period specified in the contract or for the anticipated duration of the project if this is less than 12 months. MOXON LTD limits its responsibility to claims for damages to the extent of and in accordance with the contract. Any claims arising from misuse or mishandling of any Goods supplied will not be entertained.
Any Goods supplied will be covered by the MOXON LTD standard warranty and this may be extended or shortened in accordance with the terms and requirements of the contract. MOXON LTD will within a reasonable time period with respect to the contract and at its own choice either replace, repair, or give credit for Goods found to be faulty in material, design or workmanship within the warranty period for such Goods.
We reserve the right to refuse supply to any Customer who we deem to be reselling or retailing MOXON LTD products through unapproved channels. These unapproved channels include: Any third party retail or wholesale company based in the UK or abroad; Shops and websites that have not been authorised as MOXON LTD stockists, MOXON LTD specifically do not approve selling via eBay, Amazon or any other similar website. Customers with new or moved locations should notify us for approval in advance.
The Customer does not have exclusive distribution rights of MOXON products in any territory, unless specific terms have been agreed in writing. Such an agreement will not be considered until a trading relationship has been established. Further information about MOXON policy on exclusivity agreements can be obtained upon request.
MOXON LTD do not offer any drop shipping service to your third party customer. For this reason we may verify any new delivery address request and reserve the right to refuse any order for delivery to a third party. Requests for new delivery addresses may delay your order while the address is being verified.
MOXON LTD accepts no responsibility for third party courier companies failing to adhere to allotted delivery slots or time related delivery requirements set out by the Customer. MOXON LTD will not accept any deductions or fines associated with these failings. MOXON LTD accepts responsibility for any damages to Goods in transit due to lack of sufficient packaging on products dispatched from a MOXON LTD warehouse.
In order to maintain the integrity of the MOXON LTD brand, we have established a Minimum Advertised Price (MAP) Policy for resellers of MOXON LTD products. This policy has been established to protect and support all resellers, as well as consumers of MOXON LTD products. The intention is not to interfere with the businesses of our resellers, but rather to enable customers to have sustainable business practices by allowing for a reasonable profit margin.
This MAP policy has been established by MOXON LTD to help ensure the legacy of MOXON LTD as an original and high-quality design brand, and to protect the reputation of its name and products. The MAP policy is also designed to ensure dealers and sales representatives have the incentive to invest resources into services for MOXON LTD customers.
